Legal Framework: Hazardous Substances Cleanup

Review the regulatory process governing site assessment and remediation in California. You will receive an in-depth look at the regulatory framework governing Brownfields, Superfund, RCRA Corrective Action, and other California-based cleanup programs. You will discuss federal, state and local programs governing assessments and remediation, as well as the roles and responsibilities of the U.S. EPA, Cal/EPA and their subordinate agencies, along with relevant local agencies. Topics include CERCLA (or Superfund), California Superfund program (Carpenter, Presley, Tanner Act), RCRA (hazardous waste clean up program), ARARs (clean up standard), Brownfields programs, cleanup and abatement orders, release reporting obligations, RI/FS (remedial investigation and feasibility study process), the National Contingency Plan (NCP), the administrative record and record of decision, and the hazard ranking system, among others. This course is appropriate for environmental managers, agency personnel, cleanup consultants, property owners and attorneys.
